The United States Environmental Protection Agency (U.S. EPA) strictly regulates hazardous waste under the Resource Conservation and Recovery Act (RCRA). Under these regulations, it is the generator’s responsibility to determine if it is producing hazardous waste, and to properly dispose of it.

The states of Illinois, Indiana, Michigan, Minnesota, Ohio and Wisconsin have been authorized by the U.S. EPA to enforce RCRA restrictions governing hazardous waste, and to impose stricter regulations if needed.

Additionally, the Toxic Substances Control Act of 1976 allows the U.S. EPA to require reporting, record-keeping, testing requirements and restrictions relating to chemical substances produced, imported, used and disposed of within the United States. These regulations apply to those who manufacture, import, process or distribute chemical substances commercially. Questionable substances include polychlorinated biphenyls (PCBs), used oil, radon and lead-based paints.
